You are solely responsible for determining whether your use is lawful and that you are complicit with all applicable laws. You agree that you will not use this site in a manner that may interfere with or degrade the functions of this site and the infrastructure upon which it is hosted. Atlas Tools and Machinery reserves the right to restrict access to, change or remove functionality of this site without prior notice at any time. You agree to provide true, current, complete and accurate information as requested on any registration form to which the Website may direct you.
To use this website you may be asked to provide a user name and/or password. You alone are responsible for keeping that information confidential, and for all activity this information is used for on the website. You agree to immediately notify Atlas Tools and Machinery of any unauthorized use of your password or user name or any breach of security.
You may have the opportunity to upload or publish, or otherwise send information on the website through product reviews, feedback, or other material posted. By choosing to access this website and submit content, you agree to abide by all applicable laws and regulations and the other conditions of these Terms and Conditions. You may not copy, reproduce, mirror, or otherwise duplicate and disseminate any of the contents of this site either in part or whole without express written permission by the rights holders.
3. Disclaimers and Exclusion of Liability
Atlas Tools and Machinery makes no representation about the suitability of any product on this site for any purpose. All information, including external links, is provided on this site “as is” without warranty of any kind, express or implied, about products including but not limited to availability, functionality, performance, fitness for a particular purpose, durability, or accuracy, except as otherwise provided under the law. Atlas Tools and Machinery is not liable for any direct or indirect loss or damage including but not limited to loss of data, regardless of any negligence or other fault by Atlas Tools and Machinery or any person or organization for which Atlas Tools and Machinery is responsible, even should Atlas Tools and Machinery be advised of the possibility of such damage being incurred, except in jurisdictions where such exclusions and limitations of liability are prohibited. You agree to defend, indemnify and hold harmless Atlas Tools & Machinery from and against all claims, demands, losses, costs, damages, actions, suits or other proceedings by whomever made, filed, or prosecuted in any manner arising from the provision of the goods or services. Your sole remedy for the purchase of any product on the website is to initiate cancellation or return for full or partial refund as applicable.
4. Products and Orders
Atlas Tools and Machinery offers purchasing opportunities on this website for products available in Canada. Prices are provided in Canadian Dollars (CAD) and are valid in Canada only. Prices do not include shipping and handling or sales taxes (unless otherwise indicated). While Atlas Tools and Machinery strives to maintain accurate information about pricing and availability of products and services on this website, we make no guarantee of stock availability at the time of placing your order or thereafter, nor can we guarantee complete accuracy of product information or pricing. Atlas Tools and Machinery reserves the right to revoke any advertised offer to correct such inaccuracies (with product information and/or pricing), and/or to cancel or remove items from an order that we cannot fill at that time. All payments are processed in Canadian Dollars (CAD). Atlas Tools and Machinery does not accept other forms of currency. Atlas Tools and Machinery is not liable for exchange rates and international order fees assessed and applied by your financial institution if you use any other currency as payment.
Your submission of an order is not confirmation of an offer by us to sell, but instead is an offer by you to purchase the products as advertised at the time of ordering. Your receipt of an order confirmation does not constitute acceptance by Atlas Tools and Machinery of your offer to purchase. Your order is confirmed only upon receipt of a shipping confirmation from Atlas Tools and Machinery. Atlas Tools and Machinery reserves the right to, at our sole discretion, accept, correct, adjust, limit, or decline any offer to purchase made by you for any reason, including but not limited to errors in the advertised price of products, typographical errors, or errors in product descriptions or pricing. Atlas Tools and Machinery reserves these rights whether or not your order has been confirmed or your credit card has been charged. If your card has been charged and your order is partially or fully cancelled, we will issue a credit in the amount charged for the partially or fully cancelled order, as applicable. Status updates, confirmations, and cancellations relevant to your order are communicated via email, and you are solely responsible for providing Atlas Tools and Machinery accurate contact information without typographical errors to receive these order updates.
When placing an offer to purchase, Atlas Tools and Machinery may put an immediate authorization hold on your card for the funds to complete the sale. This hold may be authorised for up to 30 days or until the payment is processed. In the event of delay in fulfilment of your order in part or whole, you may be required to submit your card information again for payment processing. Should your order be partially or fully cancelled prior to the funds being fully processed, Atlas Tools and Machinery will release the hold on the funds in the applicable amount. Atlas Tools and Machinery is not liable for any delays in the release of these funds caused by processing delays from our payment processing partners or the card-issuing financial institution associated with the payment method used by you. Atlas Tools and Machinery cannot expedite or otherwise influence the amount of time this may take, nor is it responsible for contacting any related party to do so.
Any and all coupon codes being issued by Atlas Tools and Machinery are to be used on our website and are to be used only once by a customer, unless otherwise specified. We reserve the right to refuse the use of a coupon code on any order that we deem to have abused our policy or to have been shared or reused in a manner that it was not intended to be used in. In the case that we need to refuse the use of a coupon code, we will hold the order and get in touch with the concerned person for approval of the new charge before sending the order out.
5. Pre-Orders / Back Orders / Special Orders
Atlas Tools and Machinery may offer you ordering opportunities to get priority fulfillment for orders of products as they become available. Either via Pre-Order, Back Order or Special Order. Any date advertised for release of a pre-, back-, special- ordered product is given as an estimate, and not a guarantee. Atlas Tools and Machinery may change or update the release date without notice and entirely at its own discretion. A deposit for the full value of the product, taxes included, must be paid up front to place the order. Orders are generally reviewed for processing on a first-come first-served basis, but Atlas Tools and Machinery makes no guarantee that the order will be fulfilled on this basis and reserves the right to delay or otherwise reschedule fulfillment of the order without notice. Additionally, orders are subject to all other conditions applicable to orders placed as per this Agreement. Unless noted otherwise, Special Orders are considered Final Sale.
6. Price Matching Offer
Subject to approval, Atlas Tools and Machinery will accept a price match request of any lower advertised price from an Authorized Canadian Dealer for an identical product with no difference in included bonus goods or accessories, within 30 days from the original purchase date. To be eligible for this offer, Atlas Tools and Machinery must be able to verify that the dealer has stock immediately available for delivery to your location. This price matching offer does not apply to limited-time or limited-quantity sales, used items, clearances, liquidations, misprints, advertising errors, or price reductions from rebates, coupons, loyalty rewards or similar incentives. This price matching offer is not eligible for prices from online marketplaces, such as Amazon or eBay. To be eligible for price matching, the cost of shipping and handling must be included with the competitors price to qualify for the Free Shipping promotion from Atlas Tools and Machinery, as outlined in these terms. If those costs are omitted from the competing price, Atlas Tools and Machinery may, at its own discretion, add shipping and handling charges after the price match adjustment has been made. Atlas Tools and Machinery reserves the right to decline a price match request for any reason at our discretion.
Atlas Tools and Machinery will honour a price guarantee for up to 30 days from the original purchase date. If Atlas Tools and Machinery reduces the advertised price of the product on this website, and the product is otherwise identical as advertised on this website with no change in the promotion or inclusion/exclusion of bonus goods or eligible discount codes or coupons, Atlas Tools and Machinery will refund to you the difference between the previous price and the current price in the original method of tender. The following exceptions to this apply: if it is a limited time or tiered sale, or if it is a vendor-assisted sale which is subject to inventory availability.
Promotions that state “online only” or “in store only” will only be matched if purchased through the matching Atlas channel. Atlas Tools and Machinery reserves the right to refuse the combination of any promotions.
7. Shipping
Atlas Tools and Machinery will attempt to fulfill all in-stock orders within 1 to 4 business days from the date of order confirmation for in stock items. This fulfillment period is offered only as an estimate and not to be considered a guarantee. This estimate is subject to delays from sales events, promotions, and other supply chain factors. Out-of-stock items will ship when the item is back in stock.
Atlas Tools and Machinery makes use of third-party logistics (3PL) including but not limited to courier services for delivery of orders. Upon confirmation of shipping your order, Atlas Tools and Machinery will provide, when available, tracking information from the 3PL partner. Atlas Tools and Machinery accepts liability for lost or damaged orders only up to the amount provided by the 3PL service. Atlas Tools and Machinery does not however accept any liability for shipments that have been confirmed as delivered with the 3PL service.
You are responsible for the accuracy of information provided by you for the delivery destination of your order. In submitting this information with your order, you accept that Atlas Tools and Machinery may apply additional charges to your order resulting from any incorrect or missing information, including but not limited to postal codes, business/company names, unit numbers and buzzer codes, where applicable. Likewise, Atlas Tools and Machinery is not liable and accepts no responsibility should the 3PL partner be unable to deliver to the address indicated resulting from inaccuracies in the information provided, and you are solely responsible for resolving delivery issues with the 3PL partner as per the shipment tracking information provided to you. These charges and conditions may apply regardless of any other shipping offers made by Atlas Tools and Machinery, including the Free Shipping offer.
If you are located outside of Canada, you may be subject to additional fees, brokerage, and duties beyond the scope of the service provided by this website. Atlas Tools and Machinery is not liable for any such charges brought to you by third parties. Atlas Tools and Machinery may at its sole discretion provide estimates on brokerage/duties but accepts no liability for any resulting charges. A docking fee may be applied if orders are delayed due to arrangement or payment of taxes. Atlas Tools and Machinery will require a deposit prior to shipment for docking fees. If you refuse a shipment from crossing international borders, Atlas Tools and Machinery reserves the right to, at its sole discretion, refund the order value less shipping duties, brokerage and payment gateway fees associated with the shipment, and may also be subject to an additional stocking fee up to 15% of the order total.
8. Free Shipping Offer
Atlas Tools and Machinery offers that orders placed through this website over $149 CAD in value (after discounts or coupons, before taxes) that ship to a Canadian address will be shipped free of charge, except orders that exceed 40 lbs, are oversized, or ship to “beyond destination” locations (such as locations beyond reasonable distance of major Metropolitan areas) as defined by our third-party logistics (3PL) partners. Orders exceeding 150 lbs will be shipped via freight and will be subject to additional charges. Should your order require freight charges, Atlas Tools and Machinery will contact you to agree upon these charges before shipping orders but reserves the right to cancel orders if contact cannot be established, or the charges cannot be agreed upon, within a reasonable timeframe. This offer is exclusive to this website and does not apply to any other means of ordering with Atlas Tools and Machinery, including but not limited to orders placed via phone, regardless of the methods used to complete the transaction, including use by persons for whom Atlas Tools and Machinery is responsible of this website to complete the transaction.
9. Order Cancellation and Returns
You may request to cancel an order by contacting the customer service team at Atlas Tools and Machinery. However, Atlas Tools and Machinery cannot guarantee that a request to cancel will be processed before the order is shipped. Orders cannot be cancelled after a shipping confirmation has been sent. Atlas Tools and Machinery is not liable should you fail to receive communications about or relating to order statuses including shipping confirmations.
You may return most new, unopened items within 30 days of delivery for refund up to the value of the item less shipping and handling. The following list of items are not eligible for refund and are considered final sale, without exception: abrasives, batteries, cutting tools (including bits), gas tools and gas products, gift cards, heated gear, lasers, liquids, lubricants, machinery, oils, paint sprayers, precision tool products, replacement parts, safety gear and PPE (including masks), waxes, clearance items, display models, special-ordered items, opened items in non-saleable condition and items damaged due to misuse or user error. You may request to return eligible items after 30 days for store credit. Atlas Tools and Machinery reserves the right to accept or reject such requests at its own discretion. Atlas Tools and Machinery may charge a restocking fee of up to 25% to accommodate such requests.
Requests for cancellations or returns must be sent via email to info@atlas-machinery.com. You must include your order number, as well as the item code(s) and description of the product(s) you would like to return or cancel. You are responsible for submitting accurate information for this request. Atlas Tools and Machinery is not liable if a request is not completed within any offered timeframe for eligibility of return or cancellation for reasons including but not limited to inaccuracies in the information provided. You will be issued an RMA# and a 3PL waybill if your request is accepted. The product must be returned using this waybill with the RMA# before a refund will be processed. Products returned prior to or without using this RMA# and waybill may be denied a refund, or may be subject to an additional handling fee. The customer is responsible for packing return parcels in a manner that ensures the safe arrival, in appropriate sized packaging. Atlas is not responsible for parcels shipped to Atlas without authorization, even if noted as delivered with the courier.
Should a previously approved RMA arrive in a different condition then from what was previously discussed/agreed between the customer and Atlas associate, Atlas reserves the right to decline a refund, and any associated shipping charges to send the RMA back to the customer would be the customers responsibility.
10. Privacy
Atlas Tools and Machinery collects, uses, and discloses personal information as per its Privacy Policy. Atlas Tools and Machinery may change this policy in its sole discretion without notice or liability to you, with any amendments being made available via the website. In using this website, you agree per these terms to the collection, usage, and disclosure of your personal information under the policy as it reads at the time of accepting this Agreement.
11. Governing Law
You agree that this Agreement, your use of this site and all other related matters are governed solely by the laws of Ontario, Canada, and any other applicable federal laws of Canada. Any dispute between you and Atlas Tools and Machinery or any other person relating to the use of this website, this Agreement, or related matters will be resolved via courts, tribunals, agencies, or dispute resolution organizations in Toronto, Ontario, Canada. Any provision in this Agreement that is invalid or unenforceable under applicable law will be deemed superseded by a valid enforceable provision that most closely matches the intent of the original provision, and the remaining sections of this Agreement will remain in full effect.
Mobile Terms of Service
The Atlas Tools & Machinery mobile message service (the "Service") is operated by Atlas Tools & Machinery (“Atlas Tools & Machinery”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.
By consenting to Atlas Tools & Machinery’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Atlas Tools & Machinery through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Atlas Tools & Machinery. Your participation in this program is completely voluntary.
We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.
You may opt-out of the Service at any time. Text the single keyword command STOP to +18335013245 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Atlas Machinery Supply Ltd. mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
We respect your right to privacy.
If we must legally comply with the law.
For example, we and our service providers may disclose information to respond to a subpoena or court order. We may also disclose information to a government agency or as otherwise required or permitted under Canadian law.

We may disclose your information such as name, address, phone or mobile number, email address to our suppliers or other business partners who need to contact you about a specific product in the event of including but not limited to a warrant claim, a product safety issue or recall.

If you would like to opt-out of Purolator SMS shipment notifications, please do so from their notifications. Even if you opt out of receiving our marketing messages, we may still contact you for transactional purposes like confirming an order or service request, responding to customer service inquiries, or notifying you for product recalls. Signing up for an account on our site implies that you would like to receive emails from our company.
